Newsletter Chairman's Note

Dear Friends of ESCL,
 
I am addressing you all today with a brief greeting to draw your attention to three important aspects:
 
First, I would like to draw your attention to the newly started series of our successful ESCL webinars. Our Vice-Chairman Roberto Panetta has again put together an interesting series of presentations and has been able to attract highly qualified speakers. I thank all participants for their contribution and wish us all insightful moments in these webinars.
 
Secondly, we would also like to give you an update on the ESCL Essay Prize competition. As a result of too few submissions in 2022, the jury has decided not to award a prize for the year 2022. The new competition for 2023 has already started and we are looking forward to receiving many submissions. Please also promote as many submissions as possible in your national societies so that the competition for the best ideas can take place successfully.
 
Finally, I would like to point out that the Technology and Construction Court (TCC) in London is celebrating its 150th anniversary this year. We are very pleased about that. More information about this special event and a very special publication to mark the occasion can be found here below.

The European Society of Construction Law is organizing a Webinar Program that is an initiative aiming at new interesting online events on specific subjects on construction law that will be delivered to a large audience around the globe by way of webinars.
 
The webinars last 1 hour per each and are addressed to lawyers, engineers, architects and to any other people interested in European Construction Law and alternative dispute resolution methods. Attendance of all webinars is free of charge!

ESCL Essay Prize

In 2022 the first edition of the ESCL Essay Prize took place. The jury did receive several essays on interesting topics and was very pleased with the number of submissions. Because none of the submitted essays scored sufficiently on all criteria, the jury only awarded commendations. In 2023 a new edition of the ESCL Essay Prize will take place. Deadline for submissions is 1 July 2023 17:00. It is important to note for aspiring writers that the essay will have to score at least sufficiently on all criteria to be awarded a Prize and that especially of importance is the connection of the topic and its approach with either European law or with the law of more than one European country. 150th birthday celebrations of the Technology and Construction Court

As you may know, the Technology and Construction Court (TCC) in London is celebrating its 150th anniversary this year. To mark and celebrate this important milestone, a number of events will be taking place in that year: https://www.scl.org.uk/sites/default/files/documents/FE-TCC150-London-Flyer.pdf
 
As part of the TCC’s 150th anniversary celebrations, Sir Peter Coulson and David Sawtell have edited a collection of original essays and studies by current and retired senior judges, renowned academics and leading construction and technology lawyers on the past, present and future of the court. ‘The History of the Technology and Construction Court on its 150th Anniversary Rewriting the Rules’ will be published by Hart in April 2023. Its contributors include Lord Dyson, who was instrumental in the transformation of the Official Referees’ business into the modern TCC; Sir Rupert Jackson, who presided over the TCC in the early years of the Housing Grants, Construction and Regeneration Act 1996; Sir Peter Coulson, who writes about Sir Brett Cloutman, a Senior Official Referee who was awarded the last Victoria Cross in the First World War; Dane Finola O’Farrell, who describes the practice of the TCC today; and Professor Renato Nazzini, Director of the Centre of Construction Law and Dispute Resolution at King’s College, London, who describes the contribution of the TCC to arbitration and ADR.
 
The book gathers together a range of perspectives and professional and academic backgrounds, looking at the court, the Official Referees and its judges through a range of different tones and methods, from close doctrinal analysis and archival research to individual personal recollection. This collection offers a unique insight from the judiciary, practising lawyers and academics into the birth, significance and development of the court.
