Reservation Agreements: An end to "falling through"?

If you have been selling your property and a buyer suddenly withdraws, you will know what a painful and costly experience that can be for you and others in a chain. Regretfully some 300,000 property sales fall through each year according to figures from the Homeowners Alliance. As Brexit approaches this is becoming a more common event.

The online property marketing business, RightMove, has stated (in 2018) that 29% of homes listed as "available" were previously listed as "sold subject to contract". Here at Finn's, after a sale is agreed we have a programme in place to check sales are progressing. We phone buyers and both sets of solicitors and keep our vendors up to date with progress while watching out for any problems that may be occurring. 

This year, the Government is at last working on a plan to help reduce the number of 'fall throughs': trialling a legally binding document called a Reservation Agreement. 

Under the Agreement, when an offer is accepted the seller and buyer both sign the document and the buyer hands over a proposed deposit of £1,000 which may not be refunded except in extraordinary circumstances (the framework for this will be interesting!)

Will this work? Well it is a positive step and could help reduce "gazumping" and "gazundering" where another buyer puts in a higher offer than the one already accepted, or a buyer lowers their offer just before exchange of contracts.

Similar agreements in Scotland have almost eliminated incomplete property sales.

So it may work! But until it's been tried and tested, you can trust Finn's to monitor your sale with constant updates to ensure things progress to a satisfactory conclusion.
